These Terms of Service (“Terms”) govern your use of hooklova.com (the “Site”) and any purchase you make from HookLova (“HookLova”, “we”, “us”), mailing address 25 E 40th St, Paterson, NJ 07514, USA, email [email protected]. By using the Site or placing an order you agree to these Terms, our Privacy Policy, Shipping Policy and Refund & Return Policy.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may use the Site only with the involvement of a parent or guardian.
2. Our products
- All products are handmade to order. Sizes, colours and details may vary slightly from photos; these variations are part of handmade work and are not defects.
- Our products are decorative collectibles, not toys. They are intended for ages 14 and up. They contain small parts and trims that can be a choking hazard – keep them away from children under 3 and from pets.
- Many designs are fan-inspired tributes to characters from films and TV. HookLova is not affiliated with, endorsed by or sponsored by any studio or rights holder. Character names are trademarks of their respective owners and are used only to describe what a piece looks like.
- Car hangings must be placed so they do not obstruct the driver’s view. Check local laws about objects hanging from rear-view mirrors.
3. Orders and acceptance
Your order is an offer to buy. We accept it when we start production or ship it. We may refuse or cancel any order – for example if a product is unavailable, if we suspect fraud, or if there is an obvious error in the price or description. If we cancel an order after you have paid, we will refund you in full.
4. Prices and payment
Prices are listed in US dollars and do not include import duties, taxes or customs fees, which may be charged on delivery. Payments are processed securely by third-party payment providers; we do not store your full card details. We reserve the right to change prices at any time, but changes do not affect orders already accepted.
5. Production, shipping and returns
Production times, shipping, delays, lost packages, cancellations and refunds are governed by our Shipping Policy and Refund & Return Policy, which form part of these Terms. Delivery dates are estimates.
6. Custom requests
If you ask us to write custom text or send us reference material, you confirm that you have the right to use it and that it does not infringe anyone else’s rights or contain unlawful or offensive content. We may decline any custom request.
7. Reviews and content you submit
If you submit reviews, photos or other content, you grant HookLova a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it on our Site and marketing channels. You must have the right to share it and it must not be false, misleading, unlawful or offensive. We may remove content at our discretion.
8. Intellectual property
The HookLova name and logo, our original designs, photos, text and site design are owned by HookLova and may not be copied or used without our written permission.
9. Acceptable use
You agree not to misuse the Site – including attempting to gain unauthorised access, interfering with its operation, scraping it, or using it for any unlawful or fraudulent purpose.
10. Disclaimer
Except as expressly stated in these Terms and our policies, the Site and products are provided “as is” and, to the fullest extent permitted by law, we disclaim all other warranties, express or implied. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded.
11. Limitation of liability
To the fullest extent permitted by law, HookLova will not be liable for any indirect, incidental, special or consequential damages, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Some jurisdictions do not allow these limitations, so they may not apply to you.
12. Indemnity
You agree to indemnify HookLova against claims arising from your breach of these Terms or your misuse of the Site.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in New Jersey, unless applicable consumer law gives you the right to bring a claim where you live.
14. Changes and severability
We may update these Terms from time to time; the version posted when you place an order applies to that order. If any part of these Terms is found unenforceable, the rest remains in effect.
